Non-Delegation Amendment

Whereas delegation of powers negates the separation of powers, and “the accumulation of all powers legislative, executive and judiciary in the same hands” has been termed “the very definition of tyranny”,* therefore the following amendment to the Constitution of the United States is proposed:

Congress shall not delegate its legislative powers, nor shall Congress delegate any other powers except as otherwise specifically provided by this Constitution, nor shall Congress assign executive powers to any but the President of the United States, nor assign judicial powers to any but the Supreme Court of the United States and tribunals inferior to it.

* James Madison, Federalist 47
